Is this Car Insurance Fraud?

Okay. So I don’t know what to do with this situation. About a year ago my parents co-signed for me a 2003 Mustang with 83k miles on it. I payed 7g for it and this was my dream car.

In December I was on my way down to visit my boyfriend and his cousin who was a so-so acquaintance/friend of mine and allowed her to drive my car. I had full coverage on my vehicle. Well on the high-way almost their she hit a sheet of black-ice and the car spun hit one barrier then spun again and hit the other totaling out my Mustang.

I wasn’t wearing a seat belt, hit my head on the window and was knocked unconscious for about 30 sec. When i woke up i was screaming, freaked out. I didn’t know if my insurance would cover her driving my car so we switched seats and said I had been the driver.

I received two tickets 1. Failing to have control of a motor vehicle. and 2. Failure to have proof of insurance ( was so freaked out i couldn’t find anything before the put me in the ambulance.

Well threw this entire thing she has apologized over, and over and over again saying if she could she would make it up to me. I didn’t care too much until after I knew we were both alright. So that was in December and now i come to find out. She’s sued my insurance company for $25,000. Now me taking the wrap for everything is one thing, but their is nothing wrong with her. And all i do is ball my eyes out because now shes decided she isn’t going to pay her hospital bills. Shes getting a new car and laptop ( and has commented that she has to get both better than the one’s i have, my parents helped me once again on getting another car, this time just a small Sun Fire. (( I’m very thankful for such wonderful parents)). I don’t think its right she has sued my insurance company. Shes being ridiculous and What are my legal options at this point? Have I done screwed myself or can i still stop this? Please don’t tell me how stupid I am, trust me. I already know.
Yes I had insurance i was just shaken up and couldn’t find it. It was dropped my lawyer. HOWEVER in the city this happened in ( i was out of town remember) They are more strict and gave me driveing school and quite a hefty fine. All in all not including what i had payed for the mustang, I’ve had to fork out over 4k in tickets, lawyer fee’s, driving school and two $500.00 co-payments because that city considered it two accidents sense we hit the two sides of the median at different points. Some police are crooked on that one.

Have you had success getting another driver’s insurance to pay quickly and adequately?

I was hit by another car that ran a red light — but they claim their light was green. An independent witness saw the light right after hearing the crash and says I had the green. But it’s been 10 days and I have no rental car and my older model car is a total loss. I’ve been calling to see if they other car’s insurance (which has inspected my car) has talked to the independent witness but they haven’t called back, admitted liability, or offered anything yet. How can I get them to wrap this thing up without waiting the 30 days they say they have under the law?

I’d like suggestions from those with prior experience getting good results (or from claims adjusters).

P.S. – My own insurance is no help so far — I only had liability coverage that doesn’t cover my car. Both insurance companies have inspected my car.
The police were called but refused to take a report because nobody had injuries more serious than minor aches and pains. I have one of the officer’s cards with her name.

Recently, a few people I met in Toronto and GTA decisively would not install an alarm system at home. Especially, they would not pay $30/month for monitoring. The reason they provided made me think and research. Now, really, why would one pay $30/month to an alarm monitoring company in Toronto? If there is loss to home property, insurance would cover. My research and reasoning resulted in the following:

Monitored Alarm system vs. Insurance Coverage

Robbery – attempt to take something of value from another person by use of force, threats or intimidation.

Preventative measures (security system): Whether it is residential or commercial property, a panic (or holdup) button can help. Without making it obvious to the criminal, one can have police show up in minutes.

Reactive measures (insurance policy): If police is not there and you do not have an alarm system to help you, do nor risk your life. Valuable goods are not worth your life. Moreover, if your property and belongings are insured, there is a great potential to get those covered by insurance. Make sure you keep all necessary paper work to prove your loss. Always call police after the criminal is gone. It is also good to have a video surveillance system in action.

Burglary – unlawful entry to commit a theft.

Preventative measures (monitored alarm system): Sound of alarm system often makes burglars retreat in panic. In fact, warning stickers on windows and doors often keep burglars out of your premises. However, there are smart burglars who know ins and outs security systems and are prepared for these challenges. Make sure your alarm system is smarter that those.

Reactive measures (insurance coverage): Hopefully, you are not trapped inside your premises when a burglar comes. It is always better to have an armed and monitored alarm system in place – you can arm it even when you stay inside. Insurance would cover some loss. Again, make sure you have all the paper work, call police and make a report.

Fire – in any circumstance is devastating.

Preventative measures (fire alarm system): In most cases, a properly installed alarm system with fire monitoring will notify fire station before it is too late? Damage to property is possible but usually insignificant. Smoke, CO, gas and heat detectors are required to notify fire station in time. An alarm system that makes early notice of fire allows time to evacuate and/or stop the fire.

Reactive measures (insurance policy):

If there was no fire alarm monitoring in place, the fire truck would come almost always too late. Insurance companies usually cover the loss of up to maximum allowed limits. The owner needs to have a proof of purchase and appropriate value estimates with the company. It would also cover repair of your and neighbours property.

If I get a company car, do I HAVE to get commercial insurance?

We are going to be trading in out personal car to get one to use for our small business. It will be used for both personal and business means (like the other one), except the business will be footing the bill (already taked to our accountant and all systems are go!).

What makes it a business venture is we are getting a FULL car wrap with advertising for the company on it (talk about a rolling billboard). Much better than those small magnetic signs that are hard to read.

I started looking around and found commercial insurance is WAY more expensive than personal. We are the only ones going to be driving it, we won’t carry clients in it, we won’t have any equipment in the car, so its just like the old car. So do you think I would need commercial insurance or personal?
